Acceptance of Terms and Conditions
Read the following terms and conditions (Terms) carefully before continuing. You must accept these Terms to obtain access to the Blue Cross Blue Shield of Wyoming (BCBSWY) Members Web website (Site). USING THIS SITE SIGNIFIES YOUR ACCEPTANCE OF OUR TERMS.

Usernames and Passwords
Your username and password combination protects access to your personal information. It is your responsibility to maintain the confidentiality of your username and password, and you are responsible for all activities resulting from their use, including unauthorized use. We recommend you take appropriate safeguards including regularly changing your password, using only strong passwords, and using the Logout button when you have finished your session or leave your computer. Make sure to also close your browser after logging out. If you forgot your password, please use the Forgot Password link on the login page and provide answers to the Security Questions. MEMBER SERVICES WILL NEVER ASK YOU FOR YOUR PASSWORD AND YOU SHOULD NEVER PROVIDE YOUR PASSWORD TO ANYONE.


If you suspect your password has been compromised, it is your responsibility to immediately contact Member Services at 1-800-442-2376.

Termination

Either party may, at its election and in its sole discretion, terminate access to the Site. If you wish to cancel your access to the Site, you must notify our Member Service department. BCBSWY may, at any time, terminate your access to the Site without advance notice, due, but not limited to, coverage cancellation or prolonged periods of inactivity on the Site.

E-mail Address and E-mail
You are required to provide your e-mail address when registering for access to the Site. BCBSWY may use this e-mail address to contact you with information about your account and access to the Site.


E-mail is not a secure method of communication. You should never send e-mail to BCBSWY containing personally identifiable information, nor will BCBSWY use e-mail to communicate any such information to you. Never provide your password in an e-mail. The E-Rep feature of the Site allows registered members to securely ask questions and receive answers to questions containing sensitive information, and this feature should be used instead of e-mail.


Security
BCBSWY has implemented technology and security policies, rules and measures to protect its members. Online Member Services uses the most up-to-date Secure Sockets Layer (SSL) encryption technology, the highest level of security on the Internet. The SSL protocol provides server authentication, data integrity, and privacy on the Web. SSL encrypts all transmitted information and also verifies the identity of the server to ensure that the original message arrives safely at its destination. We have obtained a digital certificate from Verisign, Inc., a leading provider of Internet trust services. When you enter the Site, an image of a closed lock or a solid key should appear in the bottom bar of your browser window. If you click on this image, a small pop-up window displaying site-security information will appear. This certificate guarantees that your personal information is being transmitted in secure (encrypted) form to BCBSWY's Member Services Web server, and not to some unknown or unauthorized server.

Use of Cookies
A cookie is a small piece of information that is sent to your browser when you access a Web site. There are two kinds of cookies, a session cookie and a persistent cookie. A session cookie is text that is stored temporarily in your computer's memory but never written to a drive. It is destroyed as soon as you close your browser. A persistent cookie is more permanent because that text is saved to a file on your hard drive. BCBSWY uses session cookies only. We do not use any persistent cookies. If your browser is set up to refuse cookies, you will not be able to access pages on the Site that require you to authenticate.


3rd Party Links
The Site contains links to other network sites. We cannot be responsible for the privacy or other practices of other organizations or the content of external Web sites.

Monitoring
BCBSWY may, in its discretion and without notice, monitor the Site and user's use thereof to determine and ensure compliance and to protect itself and other users of the Site from fraudulent, unlawful or abusive use, or for any other reason deemed necessary by BCBSWY. BCBSWY may also intercept and disclose any content, record, use or other information to the extent reasonably necessary to protect the rights of BCBSWY, for mechanical or service quality control as permitted by law, or to comply with any law, regulation, or governmental request. BCBSWY may also, in its discretion, review, edit, refuse to post or remove any material or information submitted or transmitted to the Site.


Virus Protection
BCBSWY is not responsible for any computer virus, worm, or other problem that may be associated with the use of a system such as the Site. We recommend you use a trusted virus detection product to regularly scan your system to find and remove any viruses that may be found. It is important to keep such a product up to date to ensure maximum chance of success in detecting the latest viruses.

Disclaimer of Warranties
INFORMATION AVAILABLE THROUGH THE SITE IS FURNISHED BY BCBSWY AND ACCEPTED BY USER "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY WHATSOEVER. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ARE SPECIFICALLY EXCLUDED AND DISCLAIMED. BCBSWY DOES NOT WARRANT THAT THE SITE, OR INFORMATION OBTAINED THROUGH THE SITE, WILL MEET USER'S REQUIREMENTS, THAT THE OPERATION OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ALL FAILURES OF THE SITE TO SUBSTANTIALLY CONFORM TO OR PERFORM SUBSTANTIALLY IN ACCORDANCE WITH BCBSWY'S SPECIFICATIONS WILL BE CORRECTED. BCBSWY ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN ANY CONTENT ON THE SITE. EXCEPT AS EXPRESSLY PROVIDED ABOVE AND IN SUCH WARRANTIES, IF ANY, AS MAY BE PROVIDED BY THIRD PARTY VENDORS OF EQUIPMENT OR SOFTWARE UTILIZED IN CONNECTION WITH THE SITE, THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SITE, AND INFORMATION OBTAINED THROUGH THE SITE IS WITH THE USER.

Limitation of Liability
BCBSWY will make reasonable efforts to ensure information on the Site is timely and accurate, but makes no guarantees and assumes no responsibility for the timeliness, accuracy, reliability, completeness, or usefulness of material on the Site. BCBSWY reserves the right to modify this and any other document on the Site without notification to you.


IN NO EVENT WILL BCBSWY BE LIABLE TO USER OR ANY OTHER PERSON FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA, OR OTHER SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY INFORMATION, PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED BY BCBSWY UNDER THIS AGREEMENT OR THE USE THEREOF, EVEN IF BCBSWY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, AND THE AGGREGATE LIABILITY OF BCBSWY UPON ANY CLAIMS HOWSOEVER ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY INFORMATION, PRODUCTS OR SERVICES FURNISHED OR TO BE FURNISHED BY BCBSWY UNDER THIS AGREEMENT WILL IN ANY EVENT BE ABSOLUTELY LIMITED TO THE AMOUNT PAID TO BCBSWY BY USER UNDER THIS AGREEMENT; PROVIDED, HOWEVER, THAT NOTHING IN THIS AGREEMENT SHALL OPERATE TO RELIEVE BCBSWY FROM LIABILITY FOR ITS OWN WILLFUL OR WANTON RECKLESSNESS OR INTENTIONAL TORTS.

Indemnification
You agree to indemnify, defend and hold harmless BCBSWY, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Site from and against losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site with your account.


No Legal or Medical Advice
Information provided by BCBSWY on the Site is for general information purposes only and should not be interpreted as advice or counseling of any kind to you. Information on the Site is not medical or legal advice and is not a substitute for obtaining professional advice. Always consult your own physician for appropriate medical advice and recommendations and consult your own legal counsel for questions on legal matters.

The Site and the content provided therein are protected by copyright. All rights in the pages, site content, graphics, and arrangement are owned by BCBSWY. User is prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works of or using any of the content from the Site for commercial or public purposes. You are authorized to download BCBSWY data on the Site, such as forms and claims information, for your own personal, non-commercial use only and all copyright, trademark, or other proprietary notices must remain on any such material and you may not modify these materials.


BCBSWY uses the "Blue Cross Blue Shield" trademarks and service marks under license from the Blue Cross and Blue Shield Association. Any use of these trademarks or service marks, without the prior written consent of BCBSWY and/or BCBSA, is expressly prohibited. All other trademarks and/or service marks used herein are the property of their respective owners.


Modifications
BCBSWY may modify the Terms at any time and such modifications shall be effective immediately upon posting. You agree to review the Terms periodically and by continuing use of the Site, accept any modifications to the Terms.
